The following terms and conditions will apply to: a) your use of our website; b) our supply of products and services; and c) our dealings with you.

It is an implied term that, by using the travelhorizont.com website, emailing us, or contacting us via telephone to book you confirm your agreement to and acceptance of our terms & conditions mentioned below.

Please take time to read these terms and conditions, it is important for both of us that you understand our contractual relationship relating to your use of the Channels. We will not allow you to purchase any products from any of the Channels unless you have confirmed that you have read these terms.

Governing Law
This website (site) is operated by travelhorizont.com and is intended for use by users who access the site from any country. The information and prices on the site apply to users who make a booking from any country. The website shall be governed by and construed in accordance with laws of the Republic of Croatia.


Supply of products and services

TA Travel Horizont provides travel services directly and from a wide range of tour operators, accommodation providers and carriers including, airlines, ships, railways and car rental companies. The provisions of such travel arrangements will be subject to the terms and conditions of each supplier as part of your “Conditions of Contract” with us as an agent for the supplier. We cannot list all suppliers’ terms and conditions here; you will be able to find them on their own web sites. If you are unable to do this, then please contact us.

Our website and the travel services accessible through this website are only available to those whom, and parties that may, lawfully entre into and form contracts under Croatian law, and subject to the booking conditions of the relevant tour operator. You must be 18 years of age at the time of booking a holiday, and have legal capacity (some tour operators insist that you must be 21 years of age, you must check the tour operators’ terms and conditions before booking). In addition, you must have legal capacity and authority to book as the lead name when booking for groups of 2 or more people. Any person under 18 years old must be accompanied by an adult on their journey and whilst at your stay. If you are not of 18 years old, or the legal guardian of a person under 18 years old, you are not permitted to order any products or services via our website.

It is important to note that variations of these terms differ with each tour operator. By booking through our website, you have read and agreed to be bound by the specific terms relating to the tour operators booking conditions. This is your responsibility to check before you book your holiday arrangements with us on our website acting as your agent.

This website is provided on an 'as is' and 'as available' basis. We do not accept any liability in respect of your inability to access or use this site at any time or for any interruption in that access or use, or failure to complete any transaction. We do not warrant that this site is free from computer viruses or other properties that may cause loss or damage.

Website Usage

When entering, accessing or using the website in any way, you agree with all terms and conditions. In addition, when you book any products or services with us acting as an agent for the supplier, you will do so subject to these terms and conditions on this page, and as set out in Booking Terms and Conditions and to such further terms and conditions as may be applied by the tour operator, accommodation owner and any carrier (together, the “Conditions of Contract”). These Conditions of Contract constitute an entire agreement and understanding between you and the relevant tour operator in relation to the subject matter. All bookings accepted by us and arrangements made by us are subject to the terms and conditions of the tour operator. By proceeding with a booking, you acknowledge that you have read and understood all of the Conditions of Contract and agree to be bound by them. However, if you do not or cannot accept our Conditions of Contract in full, you must stop using our website immediately. These Conditions may vary from time to time. By browsing this website you accept that you are bound by the terms and conditions current at the time when you browse or book.

This web site may display brands, trademarks and registered trademarks which are registered in Croatia and/or other countries. Unless otherwise stated, we own (or are licensed to use) the intellectual property rights in the content and information, including, without limitation, all text, sound, photographs, images, logos, videos, podcasts, blogs, graphics, design, underlying source code and software. Subject to your own personal use, material and information, either whole or part, from this web site may not be reproduced, copied, republished, downloaded, posted, broadcast or transmitted in any form or medium without our and/or the appropriate owner's prior written consent.

Third party web sites

From time to time TA Travel Horizont / travelhorizont.com may use third party web sites, links to third party sites and social networking sites to promote products and services with which they supply, as well as the promotion of special discounts. Your use of these web sites and links is entirely at your own risk and we do not accept responsibility or liability of content, use or availability of these sites.

TA Travel Horizont may from time to time use ‘micro sites’ or separate domain names (promotion sites) for the use of special promotions related to TA Travel Horizont supply of products and services. These web sites are subject to these terms and conditions and are fully owned by TA Travel Horizont. In addition, these ‘promotional sites’ will be ‘live’ for limited periods of time and may not always be available. If you have used these sites, and wish to continue using our services once the promotion has ended, you will be re-directed to www.travelhorizont.com


 

Booking Conditions


TA Travel Horizont is a tour operator, but in some occasions we do use third party combinations of travel products. This means that in that case we do not arrange or create combinations of travel products; we facilitate your connection to those who do provide or arrange travel products (whether singly or in combination) such as airlines, hoteliers, car hire companies, etc.

In completing your booking with us, you are accepting both our Terms and Conditions and the relevant supplier Booking Conditions.

Flights

You may decide to make one or more booking with us at the same time. Please note that of the various products you book, for example a flight booking or a hotel booking, in this case you will have a package booking as defined in the Package Travel.

If the insurance is not included by the supplier it will be specified before the final payment, prior to the confirmation.

For any additional insurance (beside the insurance provided by the booked flight company) please contact us directly by phone or e mail.

Booking Details

It is extremely important that you provide clear, correct information when booking, for it is this information that we make the reservation and the eventual travel provider’s contract with. Please check that all names, dates and timings are correct on receipt of all documents and advise us of any errors within two days of receipt of your documents by contacting our Customer Support department. Changes requested after this time frame may not be possible, subject to the Travel Providers terms and conditions. Please note that we will not accept any responsibility for incorrect information given. Any changes to these details will incur the amendment fees, which can be found in the Travel Providers Terms and Conditions. Please ensure that the names given are the same as in the relevant passport.

The booking information that you provide to us will be passed on only to the relevant Travel Provider (s) of your travel arrangements or other persons necessary for the provision of your travel arrangements. The information may therefore be provided to public authorities such as customs or immigration if required by them, or as required by law. This applies to any sensitive information that you give to us, such as, details of any disabilities, or dietary and religious requirements. Certain information may also be passed on to security or credit checking companies. If you are travelling to the United States, the US Customs and Border Protection will receive this information for the purposes of preventing and combating terrorism and other transnational serious crimes.

If you travel outside the European Economic Area (“EEA”), controls on data protection may not be as strong as the legal requirements in Croatia or the EU. If we were not authorised to pass this information to the relevant Travel Providers, whether in the EEA or not, we would be unable to arrange your booking. In making this booking, you consent to this information being passed on to the relevant parties.

Prices

All prices are subject to availability and final confirmation from the supplier. Further information on each Travel Providers pricing policy can be found in their booking conditions. It is important that you understand that payment at the time you are making your booking does not in itself mean that your booking is confirmed. Your booking is only confirmed when we send you confirmation of the booking. Because we are making live reservations with Travel Providers we have to have the security that we have appropriate payment from you and hence your initial payment to us is your authority to us to confirm your booking with the Travel Provider. If unexpectedly in the short time between your payment and us seeking to confirm your booking with the Travel Provider the travel product has become unavailable and we cannot obtain an alternative acceptable to you, you will of course receive a complete refund of the money you have paid for that product. You must also understand that this refund will only apply to the product which is unavailable and any other bookings will not be affected, that is, you will be committed to any other products which were booked for travel at the same time. TA Travel Horizont reserve the right to charge admin fee for services provided.

Payment

You acknowledge that TA Travel Horizont pre-negotiate certain room rates with hotel suppliers to facilitate the booking of reservations on your behalf. You also acknowledge that TA Travel Horizont provide you services to facilitate such booking of reservations for a consideration (the "facilitation fee"). The room rate displayed on the Website is a combination of the pre-negotiated room rate for rooms reserved on your behalf by TA Travel Horizont and the facilitation fee retained by TA Travel Horizont for their services. You authorize TA Travel Horizont to book reservations for the total reservation price, which includes the room rate displayed on the Website, plus tax recovery charges, service fees, and where applicable, TA Travel Horizont service taxes. You agree that TA Travel Horizont will charge your credit card for the total reservation price. Upon submitting your reservation request, you authorize the TA Travel Horizont to facilitate hotel reservations on your behalf, including making payment arrangements with hotel suppliers.

You acknowledge that except as provided below with respect to tax obligations on the amounts we retain for our services, TA Travel Horizont do not collect taxes for remittance to applicable taxing authorities. The tax recovery charges on prepaid hotel transactions are a recovery of the estimated taxes (e.g. sales and use, occupancy, room tax, excise tax, value added tax, ecc.) that TA Travel Horizont pay to the hotel supplier for taxes due on the hotel's rental rate for the room. The hotel suppliers invoice TA Travel Horizont for tax amounts. The hotel suppliers are responsible for remitting applicable taxes to the applicable taxing jurisdictions. TA Travel Horizont does not  act as co-vendors with the supplier with whom we book or reserve our customer's travel arrangements. Taxability and the appropriate tax rate vary greatly by location. The actual tax amounts paid by TA Travel Horizont to the hotel suppliers may vary from tax recovery charge amounts, depending upon the rates, taxability, etc. in effect at the time of the actual use of the hotel by our customers. We retain service fees as additional compensation in servicing your travel reservation. Service fees retained by TA Travel Horizont for their services vary based on the amount and type of hotel reservation.

You may cancel or change your prepaid hotel reservation, but you will be charged the cancellation or change fee indicated in the rules and restrictions for the hotel reservation. If you do not cancel or change your reservation before the cancellation policy period applicable to the hotel you reserved, which varies by hotel prior to your date of arrival, you will be subject to a charge equal to applicable nightly rates, tax recovery charges and service fees. In the event you do not show for the first night of the reservation and plan to check-in for subsequent nights in your reservation, you must confirm the reservation changes with us no later than the date of the first night of the reservation to prevent cancellation of your reservation.

You agree to pay any cancellation or change fees that you incur. In limited cases, some hotels do not permit changes to or cancellations of reservations after they are made, as indicated in the rules and restrictions for the hotel reservation. You agree to abide by the Terms of Use imposed with respect to your prepaid hotel reservations.

Sales, use and/or local hotel occupancy taxes are imposed on the amounts that we charge for our services (facilitation fee and/or service fee) in certain jurisdictions. For hotel stays in New York State, but outside of New York City, tax recovery charges, as described above, are collected to cover the taxes due on the rent received by the hotel for the room and there is no local hotel occupancy tax due on our services. The actual tax amounts on our services may vary depending on the rates in effect at the time of your hotel stay.

You may not book more than 5 rooms online for the same hotel/stay dates. If we determine that you have booked more than 5 rooms in total in separate reservations, we may cancel your reservations, and charge you a cancellation fee, if applicable. If you paid a non-refundable deposit, your deposit will be forfeited. If you wish to book 6 or more rooms/apartments, you must contact TA Travel Horizont group travel specialists by phone at +385(0)52 841145 or by sending us as email at
info@travelhorizont.com . One of our group travel specialists will research your request and contact you to complete your reservation. You may be asked to sign a written contract and/or pay a non refundable deposit.

With certain hotels, may be presented with the option to pay online now or pay later at the hotel. If you select the “Pay Online Now” option, TA Travel Horizont will charge the amount to your credit card in Euros, or other selected currency immediately. If you select “Pay Later at the Hotel”, the hotel will charge your credit card in the local currency at the time of your stay. Please note that taxes and fees vary between the two payment options. Tax rates and foreign exchange rates could change in the time between booking and stay.

Cancellation and Amendment


Should you find it necessary to cancel or amend your holiday, please contact your Travel Consultant/Agent immediately, we will also require written confirmation of the cancellation/amendment by the lead name on the booking by return.

Cancellation/amendment charges will apply, these charges will increase the nearer to departure the cancellation/amendment is made and can be as high as 100%. The scale of cancellation/amendment charges to be applied will be outlined in your Travel Providers booking conditions. The charges will be confirmed to you on receipt of your written instruction to cancel or amend your holiday.

In addition to any fees charged by operators, TA Travel Horizont will charge a €50 per booking administration charge for all cancellations and amendments.

Amendments made by Travel Providers


All flight timings are provisional and subject to change. However you will be advised in advance of any change as per your Travel Provider(s) booking conditions. On occasions your Travel Provider(s) may find it necessary to alter your holiday, be it a change of accommodation, service or date. In the event of a change your Travel Provider(s) will have clear guidelines set out in their booking Terms & Conditions.

TA Travel Horizont do not accept responsibility for any expenses or costs incurred by you as a result of the change and we do not accept responsibility for changes or cancellations that are due to, but not limited to, unusual or unforeseeable circumstances beyond our control. These can include war or threat of war, riot, civil strife, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, governmental action or accommodation ceasing to be available.

All bookings made, even if arranged at the same time, are separate and independent bookings. Where your Travel Provider initiates a change or cancellation to a booking, your ability to cancel or change any other bookings is not affected. For example, if your accommodation booking is changed or cancelled by your Travel Provider, the Booking Conditions of your flight booking (including cancellation charges) will still apply, and vice versa.

 

Complaints

We pride ourselves on delivering the highest standard of customer service but if you have any dissatisfaction regarding your travel arrangements they should be reported to the relevant Travel Provider or their local supplier or agent immediately. You must in the first instance make your complaint in accordance to the Travel Provider’s Terms and Conditions. If the Travel Provider is unable to resolve your concern please contact our customer services team who will try to assist you.

 

If you fail to follow this procedure there will be less opportunity to investigate and rectify your complaint. The amount of compensation you may be entitled to may be reduced or you may not receive any at all depending upon the circumstances.

If you wish to make a formal complaint upon your return home then these should be addressed in writing to Customer Support at TA Travel Horizont.

Limitation of liability

For the avoidance of doubt, your booking is directly with the Travel Provider(s). To the extent that we are not negligent in the provision of our services to you, TA Travel Horizont accepts no liability or responsibility for any complaint, loss, damage, expense or other claim in respect of any aspect of your bookings or travel arrangements. Specifically, we will not be liable for any act or omission by any person not employed directly by us and whilst we have chosen our Travel Providers with care we have no control over our Travel Providers and so cannot be held responsible for any action or omission of our Travel Providers or their servants, agents or employees. Moreover, we cannot be held responsible for any loss, damage or expense incurred or suffered by you which results from strike, civil commotion, fire, flood, war, threat of war, terrorist activity, national or nuclear disaster, late delivery, adverse weather conditions any act of God and / or any other event which is outside of our reasonable control.

In no circumstances shall we be liable for any economic loss, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of reputation, loss of anticipated savings arising out of the failure or delay in performing the services under these terms of business or otherwise in connection with these terms of business; or for any indirect, special or consequential loss or damage (howsoever arising).

In all cases, the absolute aggregate maximum liability of TA Travel Horizont under or in connection with these terms (howsoever arising) shall be limited to the total price paid by the customer for the specific bookings related to any given complaint.

Nothing in these terms of business shall limit or exclude the liability of TA Travel Horizont for death or personal injury resulting from its negligence, fraud or fraudulent misrepresentation or from any other liability, which cannot be excluded by law.

 

Insurance

Each Passenger is required to be adequately insured. We offer fully comprehensive insurance which can be added to your travel booking at the time of booking. If you have your own insurance cover you will need to inform your Travel Consultant within 48 hours of your booking, so that this information can be passed to the relevant Travel Provider. It is inadvisable to travel without insurance and TA Travel Horizont will not accept responsibility for anyone who does not contain the relevant insurance.

Passports & Visas

It is your responsibility to be in possession of a valid passport and necessary visa(s). In the absence of valid documentation, you will not be allowed to travel. In case of passengers being refused entry by any immigration or other authority all repatriation costs are to be borne by the passenger.

It is your responsibility to arrive at departure points in good time; are advice is to check with the relevant tour operator and/or carrier for exact times. In addition, it is your responsibility to ensure you arrive at your departure airport with the necessary documentation needed, including your passport. Some countries require nationals of other countries to apply for visas before they are granted entry. There may be a need for a visa if your stay exceeds 3 months or if the destined Country require so.
